 Terms of Use for FRS Tech Expert Use Upon payment or approval of account activation for a FRS Tech Expert subscription a master username/password will be provided for your account. The provided master username/password will be used to setup and manage specifics for your sites and users on FRS Tech Expert. The master username/password will be enabled for the duration of your subscription. The master username/password and all usernames/passwords and sites setup through the master username/password or associated with your subscription will be disabled if your subscription expires or is cancelled. Accounts are limited to a maximum of 5,000 job request records at any given time. Fast Rabbit Software reserves the right to trim/delete oldest records from accounts that exceed the 5,000 job request limit per master username/password. Note: deleting/trimming records (aka cleaning house) does not affect job completion counts for IT Staff. Users will not use FRS Tech Expert or any Fast Rabbit Software product or service for illegal activity. If it is found that users are performing illegal activity Fast Rabbit Software will inform authorities. The user of FRS Tech Expert, and only the user, is responsible for activities performed and data entered into the FRS Tech Expert system by the user. Fast Rabbit Software maintains the right to suspend or cancel accounts and subscriptions for any reason. Subscriptions can not be resold or transferred. Rights and Ownership Fast Rabbit Software allows current valid accounts to use the FRS Tech Expert service. Other than regular use of the service subscribers and users have no right, title or interest in or to the service or any content. Fast Rabbit Software and/or its licensors retain all rights, title and interest, including copyright and all other intellectual property rights, in and to the service and content. Indemnification You shall indemnify and hold Fast Rabbit Software, its licensors, and each such party's parents, subsidiaries, affiliates, officers, directors, employees, attorneys, and agents, harmless from and against any and all claims, costs, damages, losses, liabilities, and expenses (including attorneys' fees and costs) arising out of or in connection with your use of FRS Tech Expert (including the content) or breach of the Terms of Use for FRS Tech Expert. Third Party Products and Links to Third Party Sites Fast Rabbit Software does not endorse any sites on the Internet which are linked to, or through, or listed, or mentioned within pages of the service. In no event shall Fast Rabbit Software be responsible for any content, products, or other materials on or available from third party sites. Submissions Feature requests, bug notices, suggestions for improvements, and other submitted to Fast Rabbit Software and any intellectual rights associated with such submissions are property of Fast Rabbit Software. Disclaimer of Warranties Fast Rabbit Software and it licensors make no representation, warranty, or guarantee as to the reliability, timeliness, quality, availability, accuracy, or completeness of the FRS Tech Expert service. The service is provided "as is". Limitation of Liability In no event shall Fast Rabbit Software's total liability exceed the amount actually paid by you in the twelve month period immediately preceding the event given rise to claim. In no event shall Fast Rabbit Software or its licensors be liable for any fees or any damages arising out of, or in any way connected to use of the FRS Tech Expert service even in the case where Fast Rabbit Software or its licensors have been previously advised of the possibility of fees and/or damages. Privacy Policy Fast Rabbit Software does not sell information about subscribers to third party entities. Know Your Local Laws Fast Rabbit Software manages and operates FRS Tech Expert from within the United States of America and is subject to US Law. Fast Rabbit Software makes no representation that FRS Tech Expert is appropriate or available for use in areas outside the US. If you use FRS Tech Expert from outside the United States of America, you are solely responsible for compliance with all applicable laws. You shall comply strictly with all United States laws related to use of the FRS Tech Expert service and assume sole responsibility for doing so. Modification to Terms Fast Rabbit Software reserves the right to change the Terms of Use for FRS Tech Expert at any time and shall notify you by posting an updated version of this Terms of Use for FRS Tech Expert online. You are responsible for regularly reviewing the Terms of Use for FRS Tech Expert. Continued use of FRS Tech Expert after any such changes shall constitute your consent to such changes. The English language version of the agreement shall control. If any provision of the Terms of Use for FRS Tech Expert is held by a court of competent jurisdiction to be invalid or unenforceable, then such provision(s) shall be construed, as nearly as possible, to reflect the intentions of the invalid or unenforceable provision(s), with all other provisions remaining in full force and effect. No joint venture, partnership, employment, or agency relationship exists between you and Fast Rabbit Software as a result of Terms of Use for FRS Tech Expert, subscription to, or use of the FRS Tech Expert service. The failure of Fast Rabbit Software to enforce any right or provision in the agreement shall not constitute a waiver of such right or provision. The Terms of Use for FRS Tech Expert comprises the entire agreement between you and Fast Rabbit Software and supersedes all prior negotiations, discussions or agreements, whether written or oral, between the parties regarding the subject matter contained herein.
